전 세계적으로 AI 발전과 함께 AI 애완견 로봇 산업도 함께 성장하고 있다. AI 애완견로봇은 사람에게 애완견처럼 기능할 수 있지만 실제 개보다 더욱 다양하고 예상하지 못한위험을 야기할 수 있다. 하지만 한국의 불법행위책임 및 보험 법제는 이러한 과학발전의속도를 따라잡지 못하고 있다.
학설대립이 있지만, AI 애완견 로봇은 민법상 권리·의무의 주체가 될 수 없고, 인공지능소프트웨어는 민법상 물건으로 보기 어려우며, 자율적으로 학습하고 사고하기 때문에 사용자에게 과실책임을 묻기 어려워 불법행위책임이 성립하기 어렵다. 마찬가지 이유로, 인공지능은 물건이 아니기 때문에 제조물 책임법상 “제조물”에 해당하지 않으며, 인공지능은 구매자에게 전달 후에도 스스로 학습하여 진화하기 때문에 “제조나 설계 시 결함” 책임이 성립하기에도 적절하지 않다. 이러한 점에서 「결함 있는 제품 책임에 관한 유럽연합 지침(2024/2853)」이 소프트웨어를 제품으로 명시하고 경제주체에 무과실책임을 부과하는 법리는 시사점이 있다.
한편, AI 애완견 로봇 소유자에게 책임보험 가입을 의무화하는 방법이 있을 수 있다. 하지만, 현재 한국 법제에서는 드론에만 책임보험이 의무화되어 있고 자율주행자동차 및 자율주행선박에 대해서는 연구·시범지구에서만 제한적으로 책임보험이 의무화되어 있다. 이러한점에서 영국의 「자율주행 및 전기자동차법 2018」이 자율주행자동차가 가한 손해에 대해보험회사의 배상의무를 규정하고 자율주행자동차 소유자에게 소프트웨어 조작금지 및 업데이트 의무를 부과한 것이나, 독일의 도로교통법이 자율주행자동차 운전자에게 무과실책임을 부과하면서 자율주행모드 시에 발생한 사고에 배상한도를 확대한 것은 시사점이 있다.
과실책임주의에 기반한 한국 및 주요 국가들은 인공지능으로 인한 사고에서 책임규명의 어려움을 피하기 위해 노폴트 보험을 논의하고 있다. 과실책임자를 묻지 않고 피해자가 가입한 보험회사가 피해자에게 신속히 보험금을 지급하는 것을 노폴트포험이라 한다. 다만, 도덕적 해이 방지 및 AI 산업과 보험회사의 공존을 위해 피보험자에게 AI 애완견 로봇의소프트웨어 조작금지 및 업데이트 의무, 외출 시 목줄 착용 의무를 부과하고 보험료 미납시 자동 원격으로 로봇의 작동을 멈추게 하는 방식이 논의되고 있다.

AI robot dogs can function like real dogs to humans. However, AI robot dogs can pose a variety of unexpected risks compared to real dogs. However, Korea's tort liability and insurance laws are failing to adapt to the pace of scientific advancement.
Despite the conflicting academic views, it's difficult to hold the user of an AI robot dogs liable for causing harm to another person because AI software is not considered a "good" under civil law and autonomously learns and thinks.
For the same reason, AI is not considered a "product" under Korean product liability law because it is not a "thing" under Korean civil law. Liability for "manufacturing or design defects" also does not apply to AI because it continues to learn and think even after the buyer received it. 「DIRECTIVE (EU) 2024/2853」 is instructive because it defines software as a product and imposes strict liability on economic entities.
Meanwhile, mandating liability insurance for AI robot dogs owners could be a good alternative. However, Korean law currently mandates liability insurance only for drones. And liability insurance is only mandated for autonomous vehicles and autonomous ships in research and demonstration zones. In this regard, 「UK Automated and Electric Vehicles Act 2018」 is instructive because this law stipulates insurance companies' liability for damages caused by autonomous vehicles, prohibits autonomous vehicle owners from modifying their software, and imposes an update obligation on owners. Germany's Road Traffic Act is also instructive because this law imposes no-fault liability on autonomous vehicle owners and expands the compensation limits for accidents occurring while in autonomous driving mode.
Korea and other major countries adopting a negligence-based legal system are discussing no-fault insurance to avoid the difficulty of determining liability in AI-related accidents. No-fault insurance allows the victim's insurance company to promptly pay out insurance benefits to the victim, regardless of who is at fault.
However, to prevent moral hazard and ensure the coexistence of the AI industry and insurance companies, various obligations are being discussed for the insured. For example, software manipulation prohibiton and update obligation for AI robot dogs, and leashe obligation when outdoors.
